These Terms of Service ("Terms") govern your use of the website give.yhdev.site and participation in the free website programme offered by Give by YHDev Studio ("Give", "we", "us", or "our"), operated by YHDev Studio. By accessing this website or applying to our programme, you agree to these Terms.

1. About the Programme

Give by YHDev Studio is a social initiative through which YHDev Studio designs and builds custom websites for verified non-profit organisations at no cost to the recipient. The programme is offered on a goodwill basis and is not a commercial transaction. No payment is exchanged.

We reserve the right to accept or decline any application at our sole discretion, and to modify, pause, or discontinue the programme at any time.

2. Eligibility

To be eligible for the free website programme, your organisation must:

• Be a registered non-profit, charity, NGO, community group, or organisation with a clear social, humanitarian, environmental, or educational mission.
• Not be a for-profit business operating under a charitable guise.
• Not require an e-commerce storefront or payment processing functionality.
• Be able to provide reasonable cooperation during the project (timely feedback, content, branding materials).
• Agree to these Terms.

3. Scope of the Free Website Build

The free website build includes:

• Custom design tailored to your organisation's mission and branding.
• A mobile-responsive, multi-page WordPress website (or equivalent static site).
• On-page SEO optimisation.
• CMS (Content Management System) access so you can manage your own content.
• Delivery of full source code upon project completion.

The following are not included unless separately agreed in writing:

• Domain name registration or renewal.
• Web hosting fees.
• Ongoing maintenance, updates, or technical support after delivery.
• E-commerce or payment processing functionality.
• Content creation (copywriting, photography, video production).
• Third-party plugin licences or premium theme fees.

4. Application and Project Process

Submitting an application does not guarantee acceptance into the programme. We only contact shortlisted applicants. If you do not hear from us, your application was not selected. If accepted, we will agree on a project scope and timeline. Your cooperation is required for the project to proceed, including providing timely feedback, your organisation's branding, and any content needed for the site.

We are a small studio and take on a limited number of Give projects at a time. Accepted organisations may experience a waiting period before their project begins.

5. Intellectual Property

Upon delivery of the completed website and confirmation of your satisfaction, full intellectual property rights over the website design and code delivered to you are transferred to your organisation. YHDev Studio retains the right to:

• Display the project in our portfolio (with your permission, which is deemed granted by accepting the programme unless you notify us otherwise).
• Reference the engagement in our marketing materials.

Any third-party tools, themes, plugins, or libraries used in your website remain subject to their respective licences.

6. Your Responsibilities

You agree to:

• Provide accurate and truthful information in your application.
• Cooperate in good faith during the project.
• Not represent your organisation as a non-profit if it does not qualify.
• Use the delivered website only for lawful, non-profit purposes consistent with your stated mission.
• Ensure you have the rights to any content, images, or materials you provide to us for inclusion on your website.

7. No Warranty

The website and all services under this programme are provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the website will be error-free, uninterrupted, or meet all of your specific requirements. As this is a free programme, we do not offer service level agreements (SLAs).

8. Limitation of Liability

To the fullest extent permitted by applicable law, YHDev Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website we build for you, or from your participation in this programme. Because the programme is provided at no cost, our total liability for any claim is limited to zero (USD 0).

9. Privacy

Your use of this website and application to our programme is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

We reserve the right to withdraw or cancel an accepted application or in-progress project if we determine that the applicant provided false information, does not meet eligibility requirements, or fails to cooperate in good faith. In such cases, no website will be delivered and no compensation will be owed by either party.

11. Changes to These Terms

We may update these Terms at any time. We will indicate changes by revising the "Last updated" date. Your continued use of this website or participation in the programme after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
